Please read these terms and conditions carefully before using the services of “Alyakht.” By using our services, you fully and accurately agree to these terms and conditions.

Rental Basis:

  1. The minimum daily rental is one day (twenty-four hours).
  2. The contract duration is extendable with the consent of the company and the renter.
  3. The value of late hours beyond the scheduled return time will be calculated, with a maximum of four hours, using the following formula: (daily rental value × number of late hours) / 24 × 2 = cost of late hours.
  4. Delay in any part of an hour will be calculated as a full hour.
  5. If the renter does not request a contract extension or the company does not approve it, the renter will bear additional costs for the extra duration mentioned in the contract until the vehicle is returned to the company or recovered by the company, equivalent to 100% of the daily rental value if the delay exceeds four hours, in addition to the agreed rental costs in the contract.
  6. No modifications can be made by the renter to the contract after signing unless with the consent and approval of the company.

Renter’s Obligations:

The renter acknowledges and commits to the following:

  1. The vehicle and its contents, including tires, engine, tools, equipment, and documents, belong to the company.
  2. Return the vehicle clean both inside and outside.
  3. The vehicle is rented for personal transportation purposes.
  4. The renter has confirmed the suitability of the vehicle for their personal use.
  5. Use the fuel type specified in the contract.
  6. Notify the company of any technical malfunction in the vehicle and not carry out any repairs without approval.
  7. Inform the company immediately if the vehicle is impounded by authorities for any reason.
  8. Notify the company and law enforcement immediately if the vehicle is involved in an accident or is discovered to be stolen.
  9. Not use the vehicle in a manner that damages the engine or any component, or for any illegal purposes.
  10. Not allow unauthorized persons, as specified in the contract, to drive the vehicle for any reason, and bear responsibility for any damage or compensation resulting from such use.
  11. Not use the vehicle if it requires repair.
  12. Not use the vehicle if the authorized driver, according to the contract, is unable to drive, such as being under the influence of alcohol or drugs, or having a health condition that impairs safe driving.
  13. Not make any modifications to the vehicle and its equipment, including tampering with the odometer.
  14. Not leave the vehicle running unattended.
  15. Not transfer the company’s rights to any other party.
  16. Not represent the company to authorities without consent.
  17. Return the vehicle at the time and date specified in the contract or any extension thereof.
  18. Not transport passengers or goods for hire.
  19. Not participate in car races.
  20. Not push or tow other vehicles or tow trailers.
  21. Not use the vehicle for driving training purposes.
  22. Not re-rent the vehicle to others.
  23. Provide the company with a report on the vehicle from the relevant authority in case of traffic accidents or damage caused by natural disasters.
  24. Comply with traffic laws and regulations.

Company’s Obligations:

The company acknowledges and commits to the following:

  1. Ensure the vehicle is technically fit and safe for rental.
  2. Ensure the vehicle is clean inside and out and ready for rental.
  3. Bear full responsibility for not verifying the identity of the renter and those authorized to drive the vehicle, and the validity of the driver’s license, whether it is for the renter or those authorized by the contract to drive the vehicle.
  4. Take full care of the vehicle’s maintenance and technical condition, and maintain a record of the vehicle’s periodic maintenance.
  5. Provide the vehicle with a spare tire, tire key, jack, reflective triangular hazard warning sign, first aid kit, and fire extinguisher, all of which must be in working order.
  6. Provide the original, valid official documents for Saudi citizens, including all necessary information, and the original residency permit and driving license for foreigners for verification.
  7. Subject the vehicle to a technical inspection according to the traffic system and its executive regulations throughout the operation period.

Returning the Vehicle:

The vehicle should be returned at the specified location, date, and time or any extension thereof in the same operating condition in which it was received, considering the natural wear and tear during the rental period.

Vehicle Recovery:

The company has the right to recover the vehicle through the competent authority and at the renter’s expense, without any prior notice, in the following cases:

  1. Failure to return the vehicle at the specified date and time.
  2. Using the vehicle in violation of the contract terms.
  3. If it is found that the renter provided false information at the time of rental.

Drivers:

Authorized drivers are:

  1. The renter, if holding a driving license qualifying them to drive the vehicle.
  2. The person(s) authorized by the renter, holding driving licenses qualifying them to drive the vehicle, and whose information is recorded in the contract.
  3. Employees of the relevant authorities in emergency cases.

Insurance:

The company bears full responsibility for damages resulting from accidents, covering liability towards third parties and the rented vehicle. However, insurance does not cover the following cases:

  1. If the driver is under the influence of drugs or alcohol.
  2. If the driver is not authorized by the contract to drive the vehicle.
  3. If the accident occurs after the contract period or its extension has ended.
  4. If the vehicle is used for purposes other than those for which it was rented.
  5. If the accident occurs outside the geographic area agreed upon in the contract.

Deductible for Insurance in Case of a Traffic Accident:

The renter is responsible for a deductible ranging from SAR 2,500 to SAR 5,000, excluding tax, as stated in the electronic contract, depending on the percentage of fault indicated in the traffic accident report.

Violations of Systems and Instructions:

The renter is fully responsible for:

  1. Traffic violations caused by the driver within and outside the Kingdom.
  2. Any other violations resulting from the misuse of the vehicle or its use for illegal purposes.
  3. Leaving any personal belongings or items inside the vehicle.

Rental Costs:

The renter is responsible for the following costs:

  1. Vehicle rental throughout the contract period and any extension, as stated in the contract.
  2. Engine oil changes if the mileage exceeds the specified distance for oil change as per the contract.
  3. The deductible mentioned in the contract in the event of a traffic accident according to the previous conditions.
  4. Fuel costs and tire air pressure during the contract period.
  5. Damages resulting from the misuse of the vehicle.
  6. Damages resulting from traffic accidents, based on the renter’s liability in the accident, and damages not covered by the insurance policy or additional insurance coverage specified in the contract.
  7. Financial penalties resulting from traffic violations.
  8. Fees for using public parking.
  9. Loss, replacement, or tampering with any of the vehicle’s parts and equipment.
  10. Late return of the vehicle beyond the specified date and time in the contract.
  11. The rights resulting from the assignment of the company’s rights to any other party.

Contract Termination:

The contract ends in the following cases:

  • A) Contract Term Expiration:
    1. If the renter returns the vehicle at the date and time of the contract expiration, the contract is considered terminated.
    2. If the renter fails to return the vehicle at the agreed date and time, the company has the right to retrieve the vehicle through official authorities according to the legal procedures specified in the General Transport Authority’s regulatory guidelines.
  • B) Early Termination:
    1. The company has the right to terminate the contract before its expiration if the renter returns the vehicle. In this case, the company has the right to claim the rental fee for the actual period or the full contract period, as agreed in the contract.
    2. If the renter wishes to terminate the contract before its expiration and the company refuses to accept the vehicle, the renter has the right to file a complaint with the General Transport Authority to request contract termination. If the refusal is confirmed, the contract will be terminated from the time the complaint is submitted.
  • C) Vehicle Accident:
    1. If an accident occurs, the renter must notify the company, and the company must immediately terminate the contract and notify the renter.
    2. If the company does not terminate the contract after being notified of the accident, the renter has the right to file a complaint with the Authority, which will review the complaint and determine the actual time of contract termination.
